1. What personal data do we process, purposes of processing personal data, legal grounds and methods of collection?

If you create a new membership through https://www.tebadul.com/, your personal data is processed for the following legal purposes and reasons in accordance with Act No. 6698 on Personal Data Protection and secondary regulations:

When you register your membership in Tebadul website, your personal data related to your identity information (name, surname and nickname), contact information (phone number and email address), customer transaction information (product/service information of interest) and financial information (asset information, title deed information) contained in the information and documents you provide to the website when registering your membership are processed on a limited basis, in order to provide services provided to members, carry out sales of goods/services, carry out after-sales support services for goods/services, carry out marketing operations for products/services, carry out marketing studies and so on. This is within the legal justification stipulated in the Personal Data Protection Law, which states: “If the processing of personal data is necessary for the parties to the contract, provided that the processed data is necessary for the conclusion of the contract and the fulfillment of its obligations.”

2. Who is your personal data being transferred to and what is the purpose of the data transfer?

2.a. Inside Turkey

Your personal data is transferred within Turkey to:

• Authorized public institutions and bodies for the purposes of carrying out activities in accordance with the legislation, informing authorized persons, institutions and organizations, and following up and conducting legal affairs within the scope stipulated in the legal regulations.
• Imtilak Group companies for the purposes of carrying out commercial activities, carrying out communication activities, following up on requests and complaints, carrying out financial and accounting affairs, carrying out logistical activities, carrying out sales of goods or services, and carrying out after-sales support services for goods or services.

2.b. Outside Turkey  

• Your personal data is transferred abroad based on the legal justification of “express consent” stipulated in Article 9, paragraph 1 of the Personal Data Protection Law, due to Tebadul's use of cloud environments whose servers are located abroad, limited to the purposes mentioned above, and for the purpose of carrying out storage and archiving activities.

Rights related to your personal data and requests:

The rights relating to your personal data set forth in Article 11 of the Personal Data Protection Law are as follows:

• To be informed about whether or not your personal data is being processed.
• The right to request information about the processing as soon as it takes place.
• To know the purpose for which your personal data is being processed and to ensure that it is used in accordance with that purpose.
• To know the third parties to whom your personal data has been transferred, whether inside or outside Turkey.
• Request rectification of errors in case of incorrect or incomplete data processing.
• Request the erasure or destruction of your personal data in accordance with the relevant conditions set forth in the Personal Data Protection Law and applicable laws.
• If you request the erasure or destruction of your personal data as a result of incorrect or incomplete processing, you have the right to demand to know the third parties to whom we have transferred your personal data.
• Any person has the right to object to the results of the processing of personal data that are not in their favor, exclusively in the case of data processing and analysis through the mechanisms and systems in place.
• Demand the elimination of damage resulting from the processing of personal data in violation of the Personal Data Protection Law.
